Summary: This document is intended to provide some guidelines on the protection of the movable heritage, showing which aspects have to be addressed and clarifying the rules under international law (to which the requesting state may be a party). Where international rules are lacking, it will make non-exhaustive reference to the various heritage protection laws in Council of Europe member states. However, international obligations apart, it is up to the requesting state to adopt what it considers the best solutions in terms of its political, economic and legal structure whilst observing the basic principles of a democratic society and the right of ownership, which poses particularly important problems with respect to the movable heritage as provided for in the European Convention on Human Rights. Further guidance on this subject matter is included in the Council of Europe publication Guidance on the development of legislation and administration systems in the field of cultural heritage, incorporating two further texts: Guidelines on the protection of the architectural heritage and Guidelines on the protection of the archaeological heritage.
